Disability Act (LGD) and alternative measures

Direct hiring is the main route. When the legal conditions are met, alternative measures may be applied.

Royal Legislative Decree 1/2013, of 29 November, approving the General Act on the rights of persons with disabilities and their social inclusion, requires companies to employ at least 2% of workers with disabilities or, failing that, to adopt exceptional alternative measures, as set out in Royal Decree 27/2000, of 14 January, Royal Decree 290/2004, of 20 February, and Royal Decree 364/2005.

What is a sheltered employment centre?

A sheltered employment centre (CEE in Spanish) is a company where at least 70% of the staff are people with a disability of 33% or more, doing productive, paid work suited to their personal characteristics and supporting their social and workplace inclusion.

A team integrated into your company

Work enclaves

A labour enclave is a contract between a company in the ordinary labour market, called the partner company, and a sheltered employment centre.

Its purpose is to carry out jobs or services directly related to the partner company's main activity, for which a group of workers with disabilities from the sheltered employment centre temporarily moves to the partner company's workplace.

Advantages of setting up a labour enclave

  • It is a flexible way to outsource part of the production process.
  • It optimises internal activities that depend on manual handling work.
  • It is an alternative measure for meeting the 2% reserve quota.
  • It is a training platform for later hiring the workers onto your own staff.
  • It gives access to grants and rebates for workplace integration.

Minimum requirements to set one up

From 3 months to 3 years
The minimum duration is 3 months and the maximum 3 years, extendable if a worker is hired or the activity covered by the enclave changes.
A minimum of 5 or 3 people
The enclave must have at least 5 people in companies with 50 or more employees, or 3 in smaller companies.
60% with special difficulties
60% of the people with disabilities in the enclave must have special difficulties in accessing the ordinary labour market.
